November 17, 2006 Ms. Terry Welch 530 Longwood Glenwood, IL 60425 Dear Ms. Welch: Thank you for contacting me about the enforcement of child support orders. I appreciate knowing your views on this issue. I share your concerns about parents who do not pay their child support. Over the years, I have worked to strengthen our nation's child support enforcement system so that non-custodial parents cannot shirk their responsibilities to their children. Many families on welfare are not receiving their court-ordered child support payments. The welfare reform legislation passed in 1996 made major changes to the Child Support Enforcement program. Provisions in this law require states to implement procedures to identify non-custodial parents and obtain collections from them. I supported passage of several child support enforcement laws that were enacted when I served in the House of Representatives. These measures provided for the establishment of automated child support enforcement tracking systems; wage withholding, and the denial of drivers or professional licenses for those who fail to make required child support payments; and federal penalties for those who cross state lines to avoid child support obligations. In the Senate, I supported the Deadbeat Parents Punishment Act of 1997 (P.L. 105-187). This legislation strengthened existing federal law regarding child support. Under previous law it was only a misdemeanor to willfully fail to pay child support to a child in another state or to move from state to state to avoid a child support obligation. The new statute makes violating the law a felony. Individuals who intentionally travel from state to state to avoid a child support obligation could serve a prison sentence if the obligation has gone unpaid for over a year or is greater than $5,000. The law also created felony penalties for individuals who willfully fail to pay their child support obligation for a child residing in another state if the obligation has gone unpaid for over two years or is greater than $10,000. These tougher penalties are designed to encourage more diligent payment of child support obligations. All of the measures mentioned above are federal initiatives. Each state also has its own laws regarding child support. You may wish to contact your state representatives to get information about the handling of this matter within Illinois.
